Government to introduce licensing for non-surgical treatments

Further to our previous article Will Government Regulate The Aesthetics “Industry” we’re delighted to see that the government has committed to do just that. 

It was announced on the government’s own website on 28th February that the government would be amending the Health and Care bill to give the Health Secretary powers that would enable a licensing regime to be introduced in order to regulate cosmetic procedures such as dermal fillers and Botox.

Health and Social Care Secretary Sajid Javid said:

“While most of those in the aesthetics industry follow good practice when it comes to patient safety, far too many people have been left emotionally and physically scarred after botched cosmetic procedures.

“I am committed to protecting patient safety by making it an offence for someone to perform these cosmetic procedures without a licence.

“We’re doing all we can to protect patients from potential harm, but I urge anyone considering a cosmetic procedure to take the time to think about the impact on both their physical and mental health and ensure they are using a reputable, safe and qualified practitioner.”

This move follows recent legislation that makes it illegal to carry out injectable cosmetic treatments on under 18s. There are also restrictions in place on advertising including social media, although this is an area that has proven difficult to control.

Minister for Patient Safety Maria Caulfield said:

“The spread of images on social media has contributed to an increase in demand for cosmetic procedures such as Botox and fillers. While these can be administered safely, we are seeing an unacceptable rise in people being left physically and mentally scarred from poorly performed procedures.

“Today’s amendment is the next step on the road to effective regulation of non-surgical cosmetic procedures in England.”

Licensing Non-Surgical Treatments

Botox & Dermal Filler Practitioner / Clinic Regulation Scheme

The licensing scheme is set to put in place minimum standards for practitioners and premises where cosmetic procedures such as Botox and dermal fillers are offered:

  • Ensure that individuals carrying out non-surgical cosmetic procedures will have to meet criteria
  • Ensure hygiene and safety standards for premises

Dermal Filler Licensing

In addition to applying standards for people and clinics, there is also work underway to class dermal fillers as a medical device, which would make them subject to stringent regulations, which are currently lacking. The government press release states:

“This amendment in addition to ongoing work with the Medicines and Healthcare products Regulatory Agency on the potential to bring certain devices, such as dermal fillers without a medical purpose, in scope of medical device regulations. The government is currently analysing responses from a public consultation which ran to 25 November 2021 and will publish a formal response in due course.”

Keogh Report 2013

While it is very welcome, the government’s announcement is criticised for being slow as it comes nearly 10 years after the Keogh report made a series of observations and recommendations  https://www.gov.uk/government/publications/review-of-the-regulation-of-cosmetic-interventions. It is hoped that the consultations will legislation will change quickly.
